Under Regulation 4 of the Control of Asbestos Regulations 2012, building owners, managers, and tenant leaseholders share a strict "Duty to Manage" asbestos risks in commercial premises.
What is the "Duty to Manage"?
The Duty to Manage requires the person responsible for maintenance to:
- Take reasonable steps to find out if there are materials containing asbestos.
- Assess the risk of anyone being exposed to fibers from these materials.
- Prepare a detailed written Asbestos Register and Management Plan.
- Keep the register updated and share it with anyone working on the building fabric.
Asbestos Management Surveys
To identify asbestos-containing materials (ACMs), you need an UKAS-accredited Asbestos Management Survey. This maps the location and condition of suspect boards, pipe insulation, or ceiling tiles. If renovations are planned, a more intrusive Refurbishment/Demolition Survey is required prior to starting site works.
Managing the Risk
Not all asbestos needs to be removed immediately. If ACMs are in good condition and unlikely to be disturbed, they can be safely left in place and monitored annually. A clear log ensures safety compliance and peace of mind.
